PREAMBLE

These General Terms and Conditions of Sale govern all sales made through the website www.ecume-arcachon.com.

The website is accessible via HTTPS and ensures the security of transmitted data.

Any order placed implies the customer's full, complete, and unconditional acceptance of these Terms and Conditions.

2. PRODUCTS

The products offered for sale are those displayed on the website at the time of consultation.

Descriptions and visuals are presented with the utmost care; however, minor variations may exist without affecting the product’s conformity.

3. PRICES

Prices are indicated in euros (€), all taxes included (VAT included).

Shipping costs are calculated according to the carrier’s rates, based on the weight and dimensions of the parcel.

Shipping is free within mainland France for orders over €70.

Écume d’Arcachon reserves the right to modify its prices at any time. Products are invoiced based on the rates in effect at the time of order validation.

4. ORDER

The customer acknowledges having read and accepted the specific conditions of sale before confirming the order.

The order becomes final upon confirmation of payment.

Écume d’Arcachon reserves the right to cancel any order in the event of a prior dispute or payment incident.

5. PAYMENT

Accepted payment methods:

  • Credit card via the secure Crédit Agricole payment platform
  • PayPal
  • Bank transfer
  • Bank cheque sent to the registered office address

Online payments are secured and certified.

Orders are processed after effective validation of payment.

6. SHIPPING & DELIVERY

Shipments are made via La Poste – Colissimo tracked delivery, with or without signature. They may also be sent via Mondial Relay.

The average preparation time is between 3 and 6 working days.

Total dispatch time may reach up to 10 to 15 days after order validation.

Delivery times are provided for information purposes only.

Écume d’Arcachon’s responsibility ceases once the goods are handed over to the carrier.

In the event of loss or damage upon receipt, the customer is invited to file reservations with the carrier and contact customer service as soon as possible.

7. RIGHT OF WITHDRAWAL

In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has 14 days from receipt of the product to exercise the right of withdrawal.

The request must be sent to customer service before returning any product.

Products must be returned:

  • Complete
  • Unused
  • Unopened
  • In their original packaging

Return shipping costs are borne by the customer.

Incomplete, damaged, or used items cannot be refunded.

Refunds will be processed within a maximum of 14 days following receipt and inspection of returned products.

In accordance with Article L221-28 of the French Consumer Code, unsealed products that cannot be returned for hygiene or health protection reasons are excluded from the right of withdrawal.

8. LEGAL WARRANTIES

Products benefit from:

  • The legal warranty of conformity
  • The warranty against hidden defects

Any claim must be addressed to customer service.

9. LIABILITY

Écume d’Arcachon cannot be held liable for:

  • Improper use of products
  • Allergic reactions resulting from failure to review product compositions
  • Force majeure events

It is the customer’s responsibility to verify product compatibility with any personal sensitivities.

10. INTELLECTUAL PROPERTY

All creations, visuals, texts, trademarks, and distinctive elements of Maison Écume d’Arcachon are protected under intellectual property law.

Any unauthorized reproduction or use is strictly prohibited.

11. CONSUMER MEDIATION

In accordance with the French Consumer Code, in the event of an unresolved dispute with customer service, the consumer may refer the matter free of charge to a consumer mediator.
